I fully agree with you: In times of Facebook, WhatsApp, Instagram, Twitter and co Forums have a hard live.
The easiness of posting in social media compared with a forum is appealing for many people.
However I strongly believe, that there is a good opportunity to keep forums alive.
They are a much better storage of information you can search for!
First question: In my opinion it depends on the deal between EU and the U.K.
If they terminate the GDPR, you may just apply your local laws.
If they don't terminate, you have to apply the EU wide regulation.

Even if your site is hosted outside of the Union, as you, the provider are sitting in the union, you have to apply the regulations.

I understand what you mean.
It is basically what I wrote above. You will see in the portal new post section only one instance of a new post (even if there are ten new posts in that particular thread.
The good message is: If you hit the link from the portal section, you will be directed to the first post you did not read before. All new posts will be shown underneath.
To my knowledge, this is the regular behaviour of the software. And it makes sense to me. Otherwise my new post section list may be to short from time to time.

I try to understand what you mean:
In the moment I see within the new post section of the portal for example:
When following that link, I see two posts in that thread (from today).
Once I return back to the portal, the post is shown in non bold.
If a new post in this thread will be made, you see a new entry in this section of the portal.
If you then click onto the link, you will be directed the thr third entry (the first new one after you had visted the thread).
If there are more new posts in that thread, you will see them within the thread - but to my knowledge - not in the new post section of the portal.
I hope I'm not confusing you.

I just had a look at your forum and for me, the portal shows both: Last threads and last posts (by time)
Isn't "The Newest Posts in forum" what you are looking for?

have you tried a click into the search box?
A little window opens and gives you a few options like:
- unread posts
- unreplied threads
- topics of the last 24h
- new posts since time (your last visit)
- extended search
